Lawyers have ‘new’ technology at their disposal in the practice of law – email, internet, AI, and listservs. How does this ‘old’ rule work or conflict with the ever-evolving world of technology? ABA Formal Opinion 511, issued in May 2024, discussed confidentiality obligations of lawyers posting to listservs. Some find it interesting; others find it frustrating. This CLE will take a deep dive into the ‘old’ rule and consider its application to ‘new’ tools used by lawyers.
