CLE: Old Rule (KRPC 1.6 confidentiality) v. New Tools (technology) presented by Kathleen Selzler Lippert, Deputy Disciplinary Administrator

Please join us as Kathleen Selzler Lippert presents this CLE on the concept of a lawyer’s duty of confidentiality, under Rule 1.6, has been around for a long time -it is ‘old’. Lawyers have ‘new’ technology at their disposal in the practice of law – email, internet, AI, and listservs. How does this ‘old’ rule work or conflict with the ever-evolving world of technology? ABA Formal Opinion 511, issued in May 2024, discussed confidentiality obligations of lawyers posting to listservs. Some find it interesting; others find it frustrating. This CLE will take a deep dive into the ‘old’ rule and consider its application to ‘new’ tools used by lawyers.
